Procedure of renting a flat

Steps To be Taken
1.Ensure that the flat is ready to move in condition. Complete in all aspects (water, electricity).
2.Identify suitable tenant.(criteria given in subsequent Paras).
3. Obtain application form for tenants and also model format lease deed.
4. Fill up the application in full. No columns to be left blank.
5. Prepare lease deed. Get it notarized.
6. Personally submit the application along with photocopy of lease deed on any Thursday by 12.00 noon to secretary JVVFOWA, in the office.
7. Be available at the Screening Committee meeting on Sunday with the applicant in person. Usual timing 11AM.
8. After the application is recommended by Screening Committee, get if approval by Secretary JVVFOWA.
9. Applicant to deposit required amount with Treasurer.
10. Applicant to be shown the flat. Get the inventory signed and handover the keys of the flat.
11. It is now only that the tenant can move into the flat.
12. Society office must have communicated the details of tenant to the guard room. If for same reason it has not been done, remind Secretary JVVFOWA. Personal visit to office will speed up things.
Details
Flat (dwelling Unit)
13. Ensure that the flat has been made ready after needed repair’s that is white wash/paint etc. Overhead water tanks must be of authorized capacity. Tanks should have been cleaned, float valves fitted and made functional. Tanks must have proper lids and secured with locks. Authorized electricity meter should be in place and electricity bills should have been cleared till date. Maintenance and water charges also cleared till date. Original receipts may be asked for while clearing the application for tenancy, therefore keep them handy.
Prospective Tenant
14. Very sensitive issue. Be very particular while choosing. Following types are at best avoided:
a) Person with criminal background. (Deal may put you in trouble).
b) Persons not accustomed to living in flats.
c) Bachelors, in particular students of nearby institutes (as a rule these are not permitted any way)
d) Persons likely to conduct business activities from home.
e) Large families (ideal best is considered husband, wife, two children and in
some cases dependent parents) infrastructure for the flats does not cater to large families and therefore this caution).
15. Senior single person for example, widow, widower, divorce or single having a respectable position in a reputed organization/institute may be considered for tenancy. The rider needs to be conveyed that official conferences/meting are not to be conducted at the residence.
16. Finally the basic principle remain that the person must fit in to the culture of our society and needless to say he must have enough income through known sources, to be able to lead a dignified life at JVV.
Application For Tenancy
17. Application form can be obtained from society office at JalVayu Vihar, Greater Noida. Recently taken two passport size photos of the applicant are to be pasted at the marked spaces. Office stamp to be put on the photo and applicant has to sign across the photo. All Paras of the application to be filled. There is no Para in the application which is Not Applicable (N/A). Do not use words like same as Para.... or see Para… please rewrite the same matter over & over if the need be. A completed application will have the following.
a) Application duly filled up.
b) Association Membership Form dully filled up.
c) Photocopy of lease deed (original to be carried along)
d) Photo copy Identity Proof of applicant (pan card considered best).
e) Employment letter in original issued by the head of department, rubber stamp of the person signing the letter is must.
f) Total emoluments statement either by accounts section or a mention of this could also be made in the employment letter. In which case a separate letter is not needed for this.
g) NOC (No Objection Certificate) from previous flat owner(needed only for internal shifting).
Lease/rent agreement deed
18. To be made on minimum Rs 10/- non judicial stamp paper, to be bought in the name of flat owner. Subject matter of deed is to commence just below the stamp on stamp paper. Please state clearly the rent amount per moth, the amount of advance received by the flat owner. Maintenance and water charges per month to be paid by the tenant regularly.
19. Deed is to be signed by the flat owner and tenant on each page. Deed has to be notarized. Witnesses have to sign in full. Their addresses & telephone numbers are to be written legibly. No amendment or whit ink amendments are acceptable. For reasons of error, lease deed is to be made again on fresh.
Persons authorized to rent out a flat
20. Following three are the only persons to do so. No substitutes are permissible. President’s permission needed for exceptional cases only.
a). Flat Owner (may be asked to prove ownership, so bring the file along).
b) Registered Properly Dealer of JVVFOWA.
c) Authorized Person (By flat owner).
Authorized Person
21. Suitable person as chosen by the flat owner may be authorized to rent out a particular (solely at the risk of flat owner). Authority letter to be made on minimum Rs10/- non judicial stamp paper giving full details of the person. Recent passport size photos of both are to be pasted on the first page, to be self attested and signed across. In addition 3 sample signatures of authorized persons are need at the bottom of first page. The authority to be produced in original. Authorized person can not sign at the place meant for flat owner. In case of any doubts/ambiguities, the Association reserves the right to dishonour such authority. In such cases the flat owner has to conduct such deals personally.
General Power Of Attorney(G.P.A.)
22. G.P.A. has to be made on minimum Rs 100/- non judicial stamp paper. This can authorize a person to rent out a flat on behalf of the owner and also sign in the place meant for owner to sign. This is to be prepared in an acceptable legal language to obviate any problem arising at a later date.
Submission of applications
23. Any one of the person mentioned in Para 17 above, who is dealing with the case has to personally submit the application in the office to the Secretary JVVFOWA. Application can be submitted by 12:00 Noon on Thursday to be taken up for screening on coming Sunday.
Screening
24. Screening Committee sits on every Sunday 1100hrs to 1315hrs and takes up the cases received and cleared by the Society Office. Person who is dealing with the case and the applicants are required to be present at the society office before 1100hrs on Sunday. No substitutes of the above mentioned two individuals is acceptable for screening purpose. Once the screening committee has recommended the application further action can be initiated after getting the approval/signed by Secretary JVVFOWA.
Final Action
25. Approved application be produced to the Treasurer and requisite amount be deposited. After this is done, the guard room in-charge is informed of the tenant’s particulars and his date/time of arrival with baggage etc. When handing over the keys of flat ensure that all these formalities have been completed in order to avoid any inconvenience to the in coming resident (tenant) of Jalvayu Vihar.
